At Entrepreneurial Business School, we believe that word-of-mouth recommendations are powerful tools for connecting like-minded individuals who are passionate about entrepreneurship and eager to enhance their business skills.

By just providing us with some basic information about the individual you wish to refer using the form fields below, you will be eligible for a $2,000 (inc GST) credit towards your coaching program fees, if your referral becomes a client. *T&C’s apply. 

Once we receive your referral, our dedicated team will connect with the referred individuals. We understand the importance of personalised communication, and we assure you that we will handle each referral with the utmost importance.

REFERRAL TERMS AND CONDITIONS

An agreement between an existing Entrepreneurial Business School client who refers a new client (“Client”) to the Entrepreneurial Business School is subject to the following terms and conditions (“Conditions”).

  1. Interpretation

1.1. These Conditions set out the terms and conditions of any referral agreement (“Referral”) which the Entrepreneurial Business School (“Us”, “We”, “EBS”), will accept from a referrer (“You”, “Your”, “Referrer”) for the referral of a Client to EBS. 
1.2. Your acceptance of these Conditions, whether in writing or by conduct, signifies agreement with, and acceptance of, these Conditions in their entirety. 
2. Definitions

2.1. Business: means a reference to a firm, person, body corporate, a joint venture, partnership, an unincorporated body, or any other party that engages the services of EBS as stipulated in these Conditions.

2.2. Business Day: means a day that is not a Saturday, Sunday or any other day which is a public holiday in Maroochydore, Queensland.

2.3. Coaching Program: means a business coaching program offered by EBS and includes the EUP Program, Board of Directors Program, and 1-2-1 Programs.
2.4. Credit: means AU$2,000.00 (inc GST) to be applied to Your EBS coaching fees or donated as a percentage to the Mission Abundance Foundation Ltd. 
2.5. Intellectual Property: means all intellectual property rights, including, but not limited to, all registered and unregistered rights in respect of copyright, designs, trademarks, know-how, confidential information, patents, inventions, discoveries, logos, symbols, and domain names.
2.6. Term: means enrolments of a Client between 15 June 2024 and 30 June 2025.

  1. Referral Program and Acceptance 

3.1. In the event that You refer a Business to EBS, You will be eligible to receive a Credit for your coaching fee to your EBS account.  EBS will only apply the Credit to your account when the referred client has been engaged with EBS for 60 days.  

3.2. In the event that the Client withdraws or terminates their agreement or ceases to be a Client of EBS for 60 days, You will not be eligible for the Credit.

3.3. In the event that You and another client refer the same Client, then the Credit will be split equally between both referring clients.

3.4. These Conditions and eligibility for a Credit is strictly in accordance with the duration of the Term. 

3.5. You must complete a referral form in entirety at ebs.org/referral to receive the Credit. 

  1. Referrer’s Obligations and Covenants

4.1. The Referrer agrees and warrants to exercise the rights and pursue the opportunities granted under these Conditions in a manner consistent with the good name, goodwill, reputation, and image of EBS and in compliance with all applicable laws, regulations, and industry standards.

4.2. The Referrer may not assign, sublet, or apportion the whole or any part of their Credit except upon prior written consent from the EBS.

4.3. The Referrer and their representatives, employees, agents, contractors, and invitees must comply with the reasonable directions of EBS, or their authorised representatives, employees, agents, or contractors at all times under these Conditions.

  1. Warranties and indemnities

5.1. The Referrer agrees and warrants to indemnify and release EBS from and in relation to all actions, suits, damages, loss, claims, demands, harm, and costs which may be brought or made against or suffered or incurred by EBS in respect of or by reason of a breach of the Conditions by the Referrer or any act or omission of the Referrer, its representatives, employees, agents, contractors and invitees in or in connection with (either directly or indirectly) the performance of its obligations under these Conditions.

5.2. EBS will not be liable for any indirect or consequential damages arising out of a breach of the Conditions or otherwise relating to or arising from the offer of a Credit.

  1. Cancellation and Refunds

6.1. EBS reserves the right to cancel the Credit at their sole discretion and without limitation.   In the event of Credit cancellation, the maximum liability of EBS to the Referrer is limited to a refund of any payments made under the Conditions with no liability for any additional costs incurred by the Referrer including without limitation any other costs or expenses whatsoever.

  1. Termination

7.1. EBS may terminate this offer at any time at its sole and absolute discretion.

7.2. Any termination pursuant to this clause shall not prejudice the rights and remedies of either party in respect of any antecedent event.

  1. General

8.1. This is the entire agreement between the parties in relation to the subject matter and supersedes all previous negotiations arrangements, understandings, and commitments.

8.2. This Agreement is governed by the laws of Queensland and the parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Queensland.

8.3. No modification or variation of the Conditions shall be effective unless it is in writing and signed by both parties.

8.4. If a court, arbitrator, or other authority determines that part of the Conditions is unenforceable, illegal, or void, then it must be severed, and the other provisions of this agreement remains in force and binding on the parties.

8.5. The parties agree that nothing in the Conditions shall constitute a partnership, agency, employer/employee relationship or joint venture between them.

8.6. Any notice given to a party under or in connection with the Agreement shall be in writing and shall be sent by e-mail and must be treated as given to and received by the party to which it is addressed if sent before 5:00pm on a Business Day at the place of receipt, on the day it is sent and otherwise on the next Business Day at the place of receipt.  An email is not treated as being given or received if the sender received an error or delay message in directing that the recipient has not or may not receive the email.

8.7. The Referrer agrees that any invention, improvement, innovation, modification, discovery, or idea which it develops in connection with this agreement, whether existing or in development, will be solely the property of EBS and agrees to assign all Intellectual Property rights to EBS.

8.8. EBS reserves the right in their sole and absolute discretion to alter or change these Conditions at any time without notice to You.

8.9. EBS is not obliged to offer the Credit and may end it at any time without the need to provide alternative or additional compensation to You.  The structure and terms of the Credit Conditions are at the sole discretion of EBS and may be changed at any time.  

  1. Force Majeure
    9.1 Either party reserves the right to cancel or suspend its obligations under the Conditions which are not able to be fulfilled by virtue of an event beyond that party’s reasonable control (“Force Majeure Event”). EBS shall not be liable for any loss caused by cancellation or postponement of its obligations under this Clause. In the event that the circumstances prevent either party performing its obligations under the Conditions for 30 days or more, either party may terminate this agreement (in whole or in part) by written notice.
  2. Rights and Remedies
    10.1. The rights and remedies provided under the Conditions are in addition to, and not exclusive of, any rights or remedies provided by law.
